Processing of (personal) data by the entity in charge of the online application process
The following information provides an overview of how your personal data is processed during the application process at Qwist GmbH (also, “Qwist”, “us” or “we”) and of your rights under data protection law.

2. What is the purpose and legal basis of data processing?
We process personal data about you to review your application and qualifications. Your personal data will be processed in accordance with Section 26 of the German Federal Data Protection Act (BDSG) for the purpose of the employment relationship, insofar as this is necessary for the decision on your hiring or, after the employment relationship has been established, for its implementation and termination.
If you have agreed that your data may be stored beyond the application process for the purpose of inclusion in our talent pool (so that we can contact you later regarding a suitable job offer), this data processing is based on your consent, which you have given us separately and voluntarily (Art. 6 para. 1 lit. a, Art. 7 EU GDPR). Your consent is voluntary and can be revoked without giving reasons at any time, for example by email to dataprivacy@qwist.com or by phone or by post.
3. Who will receive your data?
Your personal data will be received by the specific departments involved in the application process, including the People & Organizations department of Qwist, which handles the organization and application process for us.
In addition, your data will be processed by certain data processors during the application process, for example by our partner Personio SE & Co. KG Seidlstraße 3 80335 München, Germany (“Personio”) via which you have provided us with you application documents. Further information on data processing by Personio can be found below (“Processing of (personal) data by the operator of the recruitment site”) and in Personio's privacy policy.
4. How long will your data be stored?
The storage period is a maximum of six months following a decision about your application, unless a contract is concluded. If we process your data on the basis of your consent in our so-called talent pool, your data will be stored at Personio for 365 days or until you withdraw your given consent.
5. What are your data protection rights?
You have a right of access to your personal data (art. 15 GDPR), a right to rectification (art.16 GDPR), a right to erasure (art. 17 GDPR), a right to restriction of processing (art.18 GDPR) and a right to data portability (art. 20 GDPR).
In case you have given your explicit consent, you have the right to withdraw your consent at any time, without affecting the lawfulness of processing before the withdrawal (art. 7 GDPR).
You may object to data processing based on legitimate interests pursuant to art. 6 para. 1 lit. f GDPR in accordance with art. 21 GDPR, if there are reasons arising from the particular situation of the data subject or if the objection is directed against direct marketing. In the latter case, there is a general right of objection that can be exercised without giving reasons.
You have the right to lodge a complaint with a data protection supervisory authority. You can exercise this right with a supervisory authority in the member state of your residence, your place of work, or the place of the alleged infringement. 6. Is there an obligation for me to provide data?
You are not obliged to provide us with your personal data. However, we can only review your application and your interest in working with Qwist if you provide us with all relevant information.
7. To what extent does automated decision making, including profiling, take place?
We do not use automated decision-making in accordance with art. 22 (1) and (4) GDPR, including profiling, in connection with your application data.
